These policies govern your use of rationalcapitaliststrategist.com. The Privacy Policy, Refund & Cancellation Policy and Consultation Terms form part of the Terms of Service.

1.0 — Terms of Service

1.1 Who we are, and what this agreement covers

Rational Capitalist Strategist LLC (“RCS”, “we”, “us”, “our”) is a New York limited liability company that publishes geopolitical and market intelligence at rationalcapitaliststrategist.com (the “Site”).

These Terms of Service (the “Terms”) govern your access to and use of the Site, our published analysis, our paid subscriptions, and our one-on-one video consultation (together, the “Services”).

The Privacy Policy, the Refund & Cancellation Policy, and the Consultation Terms are incorporated into these Terms by reference and form part of this agreement. They appear below on this same page.

By creating an account, purchasing a subscription or consultation, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1.2 Eligibility

You must be at least 18 years old and capable of forming a binding contract. The Services are not directed at children, and we do not knowingly collect information from anyone under 18.

1.3 Your account

Every purchase creates an account on the Site, including one-time consultation purchases. Your account gives you access to your receipts and invoices and lets you manage your subscription.

You are responsible for keeping your password confidential and for all activity under your account. Notify us promptly if you believe your account has been accessed without your authorization.

One subscription, one person. A subscription is personal to you. Sharing your login credentials, or providing access to subscriber content to anyone else, is a material breach of these Terms.

1.4 ⚠ Our analysis is not investment advice

This section is the most important one in this agreement. Read it.

Everything published through the Services — including written analysis, regional intelligence pages, weekly recaps, charts, economic calendars, market data, tactical positioning commentary, and anything discussed in a consultation — is general information and the author’s opinion. It is impersonal analysis published on a regular schedule to subscribers generally.

It is not:

personalized investment advice;
a recommendation to buy, sell, or hold any security, fund, exchange-traded fund, derivative, currency, or other instrument;
an offer or solicitation to buy or sell anything;
tax, legal, accounting, or financial-planning advice;
tailored to your financial situation, investment objectives, risk tolerance, time horizon, or needs, none of which we know or assess.

RCS is not a registered investment adviser and is not a broker-dealer. Nothing in the Services creates an advisory relationship, a fiduciary relationship, or any other relationship of trust or confidence between you and RCS.

Where our analysis discusses market indices, sectors, asset classes, or the exchange-traded funds that track them, it does so at an aggregate, analytical level. Such discussion is not a recommendation to trade any instrument, and you should not treat it as one.

You are solely responsible for your own investment decisions. Before acting on anything you read or hear through the Services, consult your own financial adviser, broker, or other qualified professional who knows your circumstances.

1.5 No guarantee of results

Our basis. We prepare our analysis in good faith and on a reasonable basis, using information drawn from sources we believe to be reliable at the time of publication. We do not independently verify all such information, and we make no representation or warranty that it is accurate, current, or complete.

Markets are uncertain and our analysis may be wrong.

Past performance does not indicate or guarantee future results.

We make no representation or warranty that any analysis, projection, forecast, or opinion will prove accurate.

Any performance figures shown are historical, are provided for illustration, and reflect no allowance for fees, taxes, or the costs of trading.

Investing involves risk, including the possible loss of principal.

1.6 Subscriptions, trials, and billing

We currently offer:

Both memberships include our free content and the general macro and geopolitical analysis we publish for subscribers broadly. Mapping Out Strategies additionally includes Markets-tier content — tactical, markets-focused commentary not included in The Geo-Economic Map. From time to time, a specific piece of analysis is published as two separate, tier-specific versions — one written for each membership’s audience — rather than as a single shared piece, so the two memberships will not always contain identical content.

How the trial and billing work. We collect your payment details when you sign up. The trial is free. Unless you cancel during the trial, your card is charged the annual price on the fourth day and annually thereafter until you cancel.

The trial applies once per membership. If you cancel during a trial and later resubscribe to the same membership, no trial applies and your card will be charged the full price immediately upon resubscription.

Automatic renewal. Subscriptions renew automatically each year at the then-current price. We will give you reasonable advance notice of any price change, and you may cancel before renewal if you do not wish to continue.

Cancellation. You may cancel at any time from your account page. Cancellation stops future renewals. It does not refund the current term, and your access continues to the end of the period you have paid for.

Changing plans. If you change plans mid-term, you are credited for the unused portion of your current plan and pay only the difference. Full details are in the Refund & Cancellation Policy below.

Payment processing. Payments are processed by Stripe. We do not receive or store your full card details. Your use of Stripe is subject to Stripe’s own terms.

1.7 The consultation

The one-on-one video consultation is governed by the Consultation Terms below, which apply in addition to these Terms. In the event of a conflict, the Consultation Terms govern for that product.

1.8 Our content belongs to us

All content published through the Services — text, analysis, charts, graphics, data presentations, layout, and design — is owned by RCS or licensed to us, and is protected by copyright and other intellectual-property laws.

What you may do. Access and read subscriber content for your own personal use while your subscription is active.

Freely available posts — anything published without a subscription requirement — may be shared, quoted, and republished in full, provided you credit Rational Capitalist Strategist LLC and link to the original page. This permission does not extend to the uses prohibited below, which apply to all content published through the Services whether or not a subscription is required.

Subscriber content may be quoted in reasonable excerpt, up to roughly 150 words or a single chart, with clear attribution and a link to the original.

What you may not do. Reproduce subscriber content in full, resell or sublicense it, share your login credentials, or create derivative works from it.

The following restrictions apply to ALL content published through the Services, including freely available posts, and regardless of whether a subscription is required to read it:

Use any content to train, fine-tune, pre-train, evaluate, benchmark, or otherwise develop any machine-learning model, artificial-intelligence system, large language model, or similar technology, whether for commercial or non-commercial purposes.
Scrape, crawl, harvest, or systematically extract content by automated means.
Use any automated process to access the Services in a manner that circumvents a paywall, a rate limit, or any other technical restriction.

The permission to republish freely available posts is a permission to republish them as published, to human readers, with attribution. It is not a licence to use them as training data or to ingest them into a dataset.

Our name, logo, and branding are our trademarks. Nothing in these Terms grants you a license to use them.

Copyright complaints. If you believe content on the Site infringes your copyright, or that someone is using our content without permission, contact us at contact.us@rationalcapitaliststrategist.com, or in writing at the address in section 1.19. Please identify the material, the location where it appears, and your basis for the complaint. We will respond promptly.

1.9 Prohibited conduct

You agree not to:

resell, or provide unauthorized access to subscriber content;
use the Services for any unlawful purpose, or in breach of any securities law;
interfere with the operation or security of the Site;
attempt to gain unauthorized access to any part of the Services or another user’s account;
misrepresent your identity or your affiliation with any person.

1.10 Third-party content, market data, and links

The Services display headlines, links, and data from third-party sources. Some linked sources may require their own subscriptions, which we do not provide.

We do not control third-party content, do not endorse it, and are not responsible for its accuracy, availability, or the practices of third-party sites. Following an external link is at your own risk.

Market data. Certain figures shown through the Services — including the performance percentages in our regional tables — are calculated by us from data supplied by our third-party market data providers. That underlying data remains the property of those providers.

Accordingly, and in addition to section 1.8:

The figures we display are our own calculations, provided for information only. We do not display, and do not license you to use, the underlying prices, closing values, or trading volumes from which they are derived.
You may not extract, redistribute, resell, or build a database from any market data or derived figure appearing in the Services.
You may not use these figures for trading, valuation, index construction, or any commercial purpose beyond reading them.
We do not warrant that any market data or derived figure is accurate, timely, or complete. Market data is subject to error, revision, and delay by its originating source, and our calculations depend on it.

Our arrangements with our market data providers may change. Nothing in these Terms obliges us to continue displaying any particular figure, table, or instrument.

1.11 Availability

We aim to keep the Services available, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Services, and we may change our publishing schedule or the mix of content offered.

If we permanently discontinue a paid product mid-term, we will refund the unused portion of what you have paid for it.

1.12 Suspension and termination

By you. Cancel at any time from your account page.

By us. We may suspend or terminate your account, without refund, if you materially breach these Terms — in particular by sharing credentials or reproducing subscriber content in full. Where the breach is capable of being cured and appears inadvertent, we will normally give you notice and an opportunity to fix it first.

Sections 1.4, 1.5, 1.8, 1.13, 1.14, 1.15 and 1.16 survive termination.

1.13 Disclaimer of warranties

The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

Some jurisdictions do not allow the exclusion of certain warranties. Where that applies, the exclusions above apply to the fullest extent permitted, and nothing here removes a right you have that cannot be waived by agreement.

1.14 Limitation of liability

To the fullest extent permitted by law:

We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or trading or investment losses, however caused and on any theory of liability, even if we have been advised of the possibility.
Our total aggregate liability arising out of or relating to the Services is limited to the amount you paid us in the twelve months immediately preceding the event giving rise to the claim.

Nothing in this section limits liability for fraud, fraudulent misrepresentation, or any other liability that cannot be limited by law.

1.15 Indemnification

You agree to indemnify and hold harmless RCS, its member, and its agents from any claim, demand, loss, or expense (including reasonable legal fees) arising out of:

your breach of these Terms;
your misuse of the Services;
your unauthorized distribution of subscriber content;
your violation of any applicable law or regulation; or
your violation or infringement of the rights of any third party, including any intellectual-property, privacy, or data-protection right.

1.16 Dispute resolution

Please read this section carefully. It affects how disputes between us are resolved.

Step 1 — Notice and informal resolution (required)

Before starting any formal proceeding, the complaining party must send a written notice to the other describing the dispute, the facts behind it, and the relief sought.

Notice to RCS goes to the address in section 1.19.

Notice to you goes to the email address on your account.

Both parties then have thirty (30) days to resolve the matter informally. Neither party may commence a proceeding during that period. We will engage with any notice we receive in good faith, and we ask the same of you. Most disputes are resolved at this step.

Step 2 — Small claims

Either party may bring an individual claim in small claims court, if the claim qualifies under that court’s rules. This option remains open at all times and is not affected by any other part of this section.

Step 3 — Courts

Any dispute not resolved under Steps 1 or 2 will be brought exclusively in the state or federal courts located in Westchester County, New York, or in the United States District Court for the Southern District of New York. You and RCS each consent to the personal jurisdiction of those courts.

Class action waiver

To the fullest extent permitted by law, you and RCS each agree to bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. If this waiver is found unenforceable as to a particular claim, it remains in force for all other claims, and the remainder of this section survives.

Time limit for bringing claims

Any claim you bring arising out of or relating to the Services must be commenced within one (1) year after the claim arises, or it is permanently barred, to the fullest extent permitted by law.

This one-year limit does not apply to: (a) claims by RCS relating to intellectual property, unauthorized redistribution of content, or misuse of accounts, which remain subject to the applicable statutory periods; or (b) any claim that cannot lawfully be subject to a shortened limitations period.

1.17 Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.

Nothing in these Terms deprives you of the protection of mandatory consumer-protection provisions of the law of the country or state in which you reside, where those provisions cannot be waived by agreement.

1.18 General

Changes. We may update these Terms. Material changes will be posted here with a revised “Last updated” date, and where the change materially affects your rights we will notify active subscribers by email. Continued use after the effective date of a change constitutes acceptance. If you do not accept a change, you may cancel.

Severability. If any provision is held unenforceable, it is modified to the minimum extent necessary or severed, and the remaining provisions stay in full force.

No waiver. Our failure to enforce a provision is not a waiver of it.

Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.

Entire agreement. These Terms, together with the Privacy Policy, Refund & Cancellation Policy, and Consultation Terms, are the entire agreement between you and RCS regarding the Services.

Force majeure. Neither party is liable for failure to perform caused by events beyond its reasonable control.

2.0 — Privacy Policy

2.1 Scope

This Privacy Policy explains what personal information Rational Capitalist Strategist LLC collects through rationalcapitaliststrategist.com, why we collect it, who we share it with, and what rights you have.

We do not sell personal information, we do not run advertising on the Site, and we do not use advertising pixels. We do use Google Analytics to understand how the Site is used — see sections 2.2 and 2.6.

2.2 What we collect

When you create an account or purchase

First and last name
Email address (which is also your username)
Country and State or Province
Your answer to “How did you hear about us?”, if you provide one
Your password, stored in hashed form — we never see it

We deliberately do not collect your street address, city, or postcode.

Payment information

Payments are processed by Stripe. Your card number and security code are submitted directly to Stripe and never touch our servers. We receive only a payment confirmation and limited details such as the last four digits and card brand, for receipts and support.

Automatically

Jetpack Stats — aggregate page-view statistics.

Google Analytics (GA4) — how visitors reach and move through the Site: pages viewed, referring source, approximate location derived from IP address, and device and browser information. Google Signals is switched off, so this data is never associated with signed-in Google accounts and is not used for advertising.

For visitors in Europe — including the United Kingdom, the European Economic Area, and Switzerland — we have disabled granular location and device collection in Google Analytics. For those visitors we receive only country-level location and general device type, not city, precise device model, or screen characteristics.

We run no advertising on the Site and use no advertising pixels.

Email delivery logs — our mail service keeps a record for about 14 days that a transactional email was sent to you.
Server logs — our host records standard technical information such as IP address and browser type, for security and diagnostics.

If you book a consultation

Your name, email address, and any notes you provide go to Google Calendar to create the appointment. The video call itself takes place through Google.

If you subscribe to our newsletter

Our newsletter is delivered through Substack and is free and open to anyone. If you subscribe there, Substack collects your email address under its own privacy policy.

Newsletter subscribers and paying members are separate groups. You can subscribe to the newsletter without holding an account with us, and holding an account does not add you to the newsletter.

2.3 Why we use it

We do not use your information to make automated decisions with legal or similarly significant effects, and we do not profile you.

2.4 Legal bases (for individuals in the UK, EU, and EEA)

Contract — creating your account, giving you access, taking payment, sending transactional email.

Legitimate interests — site security, aggregate analytics, understanding how people find us, and protecting our content. We have considered your interests and rights in reaching this conclusion.

Consent — the newsletter, which you may withdraw at any time by unsubscribing.

Legal obligation — tax and accounting records.

2.5 Who we share it with

We share personal information only with service providers who process it on our behalf, and only as needed:

MemberPress, which manages subscriptions, runs on our own site — that data stays with us rather than going to a third party.

We may also disclose information where required by law, to enforce our Terms, or in connection with a sale or transfer of the business — in which case we will notify you.

We do not sell or share personal information for cross-context behavioral advertising, and we have not done so in the preceding twelve months.

2.6 Cookies

Necessary cookies. Keeping you logged in, remembering your session, and securing forms. The Site will not work properly without these.

Analytics cookies. Jetpack Stats and Google Analytics set cookies to measure how the Site is used. These are not necessary for the Site to function.

We do not use advertising cookies, and we do not use third-party tracking cookies for advertising purposes.

How to opt out of analytics. You can block or delete cookies in your browser settings. For Google Analytics specifically, Google publishes a browser opt-out add-on at tools.google.com/dlpage/gaoptout, which prevents your activity being measured across every site using Google Analytics.

2.7 How long we keep it

Account and subscription records — while your account is active, and afterwards as needed for legal, tax, and accounting purposes (generally seven years for transaction records).

Email delivery logs — about 14 days.

Aggregate statistics — retained in aggregate form; they do not identify you.

Newsletter — until you unsubscribe.

You may ask us to delete your account at any time. We will do so unless we are required to keep certain records.

2.8 Your rights

Depending on where you live, you may have the right to:

access the personal information we hold about you;
correct inaccurate information;
delete your information;
port your information to another service;
object to or restrict certain processing;
withdraw consent where processing relies on it;
opt out of sale or sharing — although, as stated, we do not sell or share.

To exercise any of these, email contact.us@rationalcapitaliststrategist.com. We will respond within the period required by applicable law. We may need to verify your identity first, which normally means confirming control of the email address on the account.

We will not discriminate against you for exercising these rights.

If you are in the UK, EU, or EEA, you may also complain to your local data protection authority.

2.9 International transfers

We are based in the United States, and our service providers are principally in the United States. If you access the Services from outside the US, your information will be transferred to and processed in the US. Where required, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses, which our providers implement. As noted in section 2.2, we further limit what is collected from European visitors in the first place.

2.10 Security

We use HTTPS throughout, store passwords in hashed form, keep payment processing entirely with Stripe, and limit administrative access to the principal.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

2.11 Children

The Services are not directed at anyone under 18, and we do not knowingly collect their information. If you believe a child has provided us information, contact us and we will delete it.

2.12 Changes

We may update this Privacy Policy. Material changes will be posted here with a revised “Last updated” date, and we will notify active subscribers by email where the change materially affects them.

3.0 — Refund & Cancellation Policy

3.1 The short version

Both subscriptions start with a 3-day free trial. Your card is charged on day 4.

The trial is your evaluation period. Cancel during it and you pay nothing.

After the trial, we do not refund subscription fees.

You can cancel at any time from your account page. You keep access to the end of the period you have paid for.

3.2 How the trial works

When you sign up for The Geo-Economic Map ($100/year) or Mapping Out Strategies ($250/year), we collect your payment details and give you access in accordance with each tier immediately. The first three days are free.

If you do not cancel before the trial ends, your card is charged the full annual price on the fourth day, and annually thereafter.

Cancel at any point during those three days and you are not charged at all.

The trial is a one-time offer per membership. If you cancel during a trial and resubscribe to the same membership later, the trial does not apply again — your card is charged the full price immediately upon resubscription.

3.3 How to cancel

Log in, go to your account page, and cancel from there. It takes effect immediately — no email, no phone call, no waiting for us to respond.

If you have trouble, email contact.us@rationalcapitaliststrategist.com and we will cancel it for you.

3.4 What happens when you cancel

Automatic renewal stops. You will not be charged again.

Your access continues to the end of the period you have already paid for. If you paid for a year and cancel in month three, you keep access for the remaining nine months.

You are not refunded for the remainder of the term.

3.5 Our refund position

We do not refund subscription fees after the free trial has ended.

The three-day trial exists precisely so that you can evaluate the publication at no cost before any money changes hands. Once the trial ends and the charge is made, the fee for that term is not refundable — whether you cancel the next day or ten months later.

This is why we make the trial genuinely free, tell you plainly when the first charge falls, and let you cancel yourself at any time without having to ask.

3.6 When we do refund

We will issue a refund where:

you were charged in error — a duplicate charge, a charge after a valid cancellation, or a billing mistake on our side;
we permanently discontinue a paid product mid-term, in which case we refund the unused portion;
a refund is required by applicable law, including any mandatory cooling-off right in your jurisdiction.

If you believe you have been charged in error, email us. We would rather fix a mistake than argue about it.

3.7 Changing plans

Upgrading or downgrading mid-term. You are credited for the unused portion of your current plan, calculated pro rata from the time remaining in the term, and you pay only the difference. The credit reflects time not yet used, not the whole amount you paid.

If the credit covers the entire cost of the new plan, you pay nothing today — but we will still ask for card details, because the subscription needs a payment method on file for your next renewal.

The credit is applied against the new plan. It is not paid out as a refund.

3.8 The consultation

The one-on-one video consultation is a one-time $500 purchase and is non-refundable once purchased, except where section 3.6 applies.

Rescheduling is free. Please use the calendar invite sent to you to move your appointment.

If you have purchased a session and not yet used it, it does not expire — contact us and we will help you schedule it.

If we need to cancel and cannot offer you a reasonable alternative time, we will refund you in full.

3.9 Price changes

We may change our prices. Any change applies from your next renewal, never mid-term, and we will give you reasonable advance notice so you can cancel before it takes effect.

4.0 — Consultation Terms

These terms apply to the One-on-One Video Consultation. They apply in addition to the Terms of Service above, and where the two conflict, these terms govern for this product.

4.1 What you are buying

A 60-minute video session with Rodrigo C. Serrano, CFA, at a time you choose from the available slots, for a one-time fee of $500.

The session is a general educational discussion of economic, financial, and geopolitical developments — the same subject matter covered in the publication, discussed live and in response to your questions.

Typical ground includes macroeconomic conditions, how regional and geopolitical dynamics are affecting markets, how to think about the analysis published on the Site, and general concepts in investing and market analysis.

4.2 ⚠ What you are not buying

This is the most important section of these terms.

The consultation is not personalized investment advice, and it will not become personalized investment advice on request.

During the session, we will not:

review, analyze, or comment on your specific portfolio or holdings;
recommend that you buy, sell, or hold any specific security, fund, exchange-traded fund, or other instrument;
advise on your asset allocation, position sizing, or how much to invest;
provide financial planning, retirement, tax, accounting, insurance, or estate advice;
assess your risk tolerance, time horizon, financial circumstances, or investment objectives, or give advice premised on them;
manage, or offer to manage, any assets on your behalf.

RCS is not a registered investment adviser and is not a broker-dealer. The consultation does not create an advisory relationship, a fiduciary relationship, or any other relationship of trust or confidence between you and RCS.

If you ask a question that would require personalized advice to answer, we will say so and redirect the discussion. This is not evasion — it is the boundary that defines the product, and we hold it consistently.

For advice about your own situation, consult a financial adviser, broker, accountant, or attorney who knows your circumstances and is authorized to advise you.

4.3 Booking, rescheduling, and missed sessions

Booking. After purchase you receive a link to a scheduling calendar. Choose any available slot. A confirmation email follows.

The notes field matters. The booking form includes a field for the general topics you would like to cover. It can only be completed when you book — there is no way to add notes afterwards. If you skipped it, email us instead; do not book a second appointment.

Rescheduling is free. Use the link in your confirmation email.

If you miss your session without rescheduling, we will make one reasonable effort to rearrange it. Repeated no-shows may be treated as the session having been provided.

If we need to cancel, we will offer alternative times. If none works, we refund you in full.

4.4 The session itself

Held by video call through Google.

We do not record sessions. If you wish to record, ask first — recording without the other party’s agreement may be unlawful where you are.

Anything you tell us about your circumstances is treated as confidential and is not shared or published. Please do not send account numbers, statements, or other financial documents — we do not need them and do not want them.

4.5 Fees and refunds

$500, one-time, payable at purchase. Not a subscription; nothing renews.

Non-refundable once purchased, except as set out in the Refund & Cancellation Policy above.

Sessions do not expire. If you have bought one and not used it, contact us.

You may purchase additional sessions at any time.

4.6 No guarantee

Nothing said in a consultation is a guarantee, prediction, or assurance of any outcome. Our opinions may be wrong. Any action you take following a consultation is your own decision and your own responsibility.

4.7 Limitation of liability

The limitation of liability in section 1.14 of the Terms of Service applies to the consultation. Our total liability in connection with a consultation will not exceed the $500 fee paid for it.

4.8 Speaking engagements

Speaking engagements are arranged separately by email and quoted individually. They are not covered by these terms; each is governed by whatever is agreed in writing at the time.
